Problems And Effectiveness Of Law Enforcement Of Sexual Violence Crimes In The Implementation Of The TPKS Law In Indonesia
Abstract
Sexual violence constitutes a serious violation of human rights with significant impacts on victims. The Law on Sexual Violence Crimes (TPKS Law) represents a progressive step in strengthening legal protection and law enforcement against perpetrators. This study aims to analyze the challenges in law enforcement and assess the effectiveness of the implementation of the TPKS Law in Indonesia. This research employs a normative legal method with statutory and conceptual approaches, utilizing primary and secondary legal materials. The findings indicate that law enforcement still faces several obstacles, including limited understanding among law enforcement officials, difficulties in evidence gathering, inadequate victim services, and socio-cultural factors that hinder reporting. Nevertheless, the TPKS Law has provided a more comprehensive legal framework for victim protection and recovery. Therefore, improving the effectiveness of its implementation requires enhancing the capacity of law enforcement officials, optimizing victim services, and increasing public legal awareness.
