Criminal Liability in Cases of Aggravated Oil Palm Fruit Theft (A Study of Court Decision Number: 699/Pid.B/2023/PN.Rap)
Abstract
Criminal liability in cases of aggravated oil palm fruit theft is a crucial aspect of law enforcement. This addresses the need to deter offenders while simultaneously protecting the interests of plantation owners. Theft of oil palm fruit is a common offense, particularly in regions with extensive plantations; the fruit holds significant economic value, making it a prime target for theft.
This study further examines criminal liability in cases of aggravated oil palm fruit theft (specifically analyzing Court Decision No. 699/Pid.B/2023/PN.Rap). It employs a normative-juridical research method, relying on legal norms found in legislation and court rulings, as well as societal legal norms.Criminal liability in cases of aggravated oil palm fruit theft is established based on the fulfillment of elements under Article 363 Paragraph (1) Point 4 of the Indonesian Criminal Code (KUHP), which covers aggravated theft—specifically theft committed jointly by multiple perpetrators. An analysis of the court ruling in Case No. 699/Pid.B/2023/PN.Rap reveals that the judge explicitly determined the elements of culpability, capacity for criminal liability, and unlawful conduct on the part of the defendant were met, thereby warranting the imposition of a criminal sentence.
