Juridical Review of Religious Freedom in Children of Interfaith Parents
Abstract
This research aims to discuss in depth the regulations and legal stance of interfaith marriage in Indonesia, as well as comprehensively analyze the legal policy for the protection of children's rights from interfaith parent marriage. The type of research used is normative juridical with a descriptive-analytical approach, discussing existing legal symptoms and problems and testing them based on applicable laws and regulations. The results of this study show that Indonesia guarantees the freedom of everyone to form a family and continue their offspring through legal marriage, but marriage must be guided by the provisions of applicable laws, such as the Marriage and Human Rights Law. Legal policies for the protection of children's rights from the marriage of parents of different religions include: guarantee of freedom for children to embrace the religion/belief they believe, protection from discrimination, protection of identity, and protection to get inheritance rights from parents/families.
