Juridical Analysis Of The Criminal Offense Of Collective Violence (Study Of Decision Number 994/Pid.B/2025/PN Mdn)
Abstract
The criminal act of collective violence is an act committed by two or more persons using violence against individuals or property openly, thereby disturbing public order and causing harm. This study aims to analyze the application of its legal elements and the judge’s considerations in Decision Number 994/Pid.B/2025/PN Mdn. The method used is normative juridical with statutory and case approaches. The results show that the elements must be cumulatively fulfilled, including multiple perpetrators, violence, openness, collective force, and targets against persons or property. Evidence includes witness testimony, visum et repertum, and trial facts. The judge found all elements proven and imposed imprisonment of 2 years and 6 months, considering aggravating and mitigating factors.
