Analysis of a Judgment Regarding Criminal Sanctions for Child Abuse Where The Child is the Victim (Study Of Judgment No. 5804 K/Pid.Sus/2024)
Abstract
Children are a vulnerable group who are often victims of violence invarious aspects of life whether within the family, the community, or the school environment—and whether in situations of family conflict or in daily life. There are many cases of children falling victim to physical and mental violence, particularly in Indonesia, for example, domestic violence (DV), human trafficking, sexual abuse, and various other forms of criminal violence. This study employs a normative legal approach using qualitative methods, specifically research that focuses on the examination of legal norms through the analysis of legislation, legal doctrine, and relevant literature. Research data was obtained from legal literature and analyzed using descriptive qualitative methods to understand, interpret, and explain the legal issues under investigation. The research results are expected to provide a theoretical contribution to the development of policies regarding legal protection for victims within the existing system, in an effort to enhance legal protection and the role of the Indonesian Child Protection Commission (KPAI) in Indonesia as a means of enforcing the law in a more humane and effective manner toward victims.
