The Role Of The Election Supervisory Body (Bawaslu) In Upholding The Principles Of Constitutional Democracy In Indonesia
Abstract
The General Election (Pemilu) is the main pillar of constitutional democracy in Indonesia. Its implementation must guarantee the principles of justice, transparency, and accountability as mandated by the 1945 Constitution of the Republic of Indonesia. In this context, the Election Supervisory Body (Bawaslu) plays a strategic role as an independent and responsible institution overseeing the administration of elections to ensure that every stage of the electoral process adheres to the principles of constitutional democracy.This study aims to analyze the role and effectiveness of Bawaslu in upholding the principles of constitutional democracy, as well as to identify the obstacles faced in carrying out its supervisory functions. The research method used is a normative juridical approach, which examines statutory regulations and constitutional law doctrines. The results of the study show that Bawaslu plays an essential role in enforcing the principles of constitutional democracy through its functions of prevention, supervision, and enforcement of electoral violations. However, its effectiveness is still constrained by limitations in human resources, restricted authority, and political interference. Therefore, it is necessary to strengthen the institutional capacity of Bawaslu so that it can optimally perform its constitutional role.
