Legal Protection of Intellectual Property Rights as Strengthening MSMEs in National Economic Development National
Abstract
This study aims to examine legal protection of Intellectual Property Rights (IPR) as an instrument for strengthening Micro, Small, and Medium Enterprises (MSMEs) in national economic development. In the era of globalization and the creative economy, IPR plays an important role not only as a form of recognition of intellectual work, but also as an economic asset that can increase the competitiveness and added value of MSME products in domestic and international markets. This study uses a normative legal research method with a statute approach and a conceptual approach. The results show that although the Indonesian legal system has provided a basis for IPR protection and registration mechanisms, its implementation has not been optimal due to low legal awareness among MSME actors, limited intellectual asset valuation, and minimal support from financial institutions for IPR-based financing. Therefore, this study recommends the need to improve legal literacy or socialization for MSME players, institutional synergy between the government, and the formulation of operational policy regulations that can strengthen the function of IPR as a productive asset in strengthening MSMEs. In conclusion, IPR legal protection plays an important role as the foundation for the creation of an innovative, competitive, and sustainable creative economy in supporting national economic development.
