Legal Protection For Women Victims Of Sexual Violence Based On Law Number 12 Of 2022 Concerning The Criminal Acts Of Sexual Violence

Abstract

Sexual violence against women is a form of human rights violation that causes physical, psychological, social, and economic impacts on victims. The enactment of Law Number 12 of 2022 concerning the Crime of Sexual Violence provides a stronger legal basis for protecting and restoring the rights of victims comprehensively. This study aims to analyze the legal protection for women victims of sexual violence under Law Number 12 of 2022 concerning the Crime of Sexual Violence and to examine the victim recovery efforts regulated under the law. This research employs a normative legal research method with a qualitative approach. The data consist of primary and secondary legal materials collected through library research and supported by an analysis of decisions of the Medan District Court and policy documents related to the protection of victims of sexual violence. The data were analyzed descriptively using a qualitative approach and deductive reasoning. The findings indicate that Law Number 12 of 2022 provides more comprehensive legal protection than previous regulations by guaranteeing victims' rights to handling, protection, and recovery. Such protection is implemented through legal assistance, health services, identity protection, medical rehabilitation, psychological rehabilitation, social rehabilitation, and restitution. Furthermore, victim recovery is carried out through integrated coordination among the government, law enforcement agencies, the Witness and Victim Protection Agency (LPSK), healthcare professionals, psychologists, social workers, advocates, and the community. Therefore, Law Number 12 of 2022 has implemented a victim-oriented criminal justice system as a manifestation of respect for human rights while promoting justice, legal certainty, and legal benefits for women victims of sexual violence..
