Legal Analysis of Legal Protection for Children as Victims of Sexual Violence Based on Law Number 12 of 2022
Abstract
This study aims to analyze legal protections for children who are victims of sexual violence based on Law No. 35 of 2014 on Child Protection and Law No. 12 of 2022 on Criminal Acts of Sexual Violence, as well as to examine the criminal liability of juvenile perpetrators of sexual violence based on Law No. 11 of 2012 on the Juvenile Criminal Justice System. The research method used is normative legal research with a conceptual approach. Data were collected through a literature review of relevant laws, books, and journals. The results of the study indicate that legal protection for child victims of sexual violence includes special protection, support, rehabilitation, recovery, and restitution as efforts to realize the victims’ rights. Meanwhile, juvenile offenders can still be held criminally liable through the juvenile criminal justice system, which prioritizes the best interests of the child and restorative justice. Therefore, it is necessary to strengthen the enforcement of laws and regulations and improve interagency coordination to ensure effective and fair legal protection for child victims of sexual violence.
