Legal Protection for Victims of Verbal Sexual Harassment (Catcalling) in The Workplace (Case Study Of D'crispy Binjai)
Abstract
This study aims to analyze legal protection for victims of verbal sexual harassment (catcalling) in the workplace under Indonesian law and to examine prevention and response efforts undertaken at D'crispy Binjai. Although often considered trivial or merely a joke, catcalling is a form of non-physical sexual harassment that can have profound psychological impacts and create a hostile work environment for victims. The research method used is empirical, with primary data collected through interviews and direct observation, and secondary data collected through literature review of various legal materials. The results show that legal protection for victims of catcalling in Indonesia is regulated in several legal instruments, including the Criminal Code (KUHP), Law Number 13 of 2003 concerning Manpower, and specifically in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS). Article 5 of the TPKS Law provides a clear legal basis for punishing perpetrators of non-physical sexual harassment with imprisonment and fines. At D'crispy Binjai, preventative measures include educating new employees about internal policies, strictly prohibiting all forms of verbal and physical harassment, and providing a safe reporting mechanism for victims. This study concluded that addressing catcalling requires a synergy between strengthening government regulations, responsive internal company policies, and raising collective public awareness to create a safe environment that respects the dignity of every individual.
