Legal Review of Consumer Protection In Online Buying And Selling Transactions With SameDay Delivery Method In Medan (Shopee MarketPlace Medan)

Abstract

The development of e-commerce in Indonesia has driven the increasing use of instant delivery services (same-day delivery), including in Medan City through the Shopee marketplace. This phenomenon offers convenience for consumers, but also raises issues related to delivery delays, damaged goods, and confusion over legal responsibilities between marketplaces, sellers, and logistics service providers. This study aims to analyze consumer legal protection in online transactions using the same-day delivery method in Medan through the Shopee platform, as well as to identify the obstacles and effectiveness of available dispute resolution mechanisms. The research method used is a normative juridical approach with a case-based approach. Data was collected through a literature review of laws and regulations such as Law Number 8 of 1999 concerning Consumer Protection, the Electronic Information and Transactions Law, and Government Regulation No. 80 of 2019 concerning Commerce Through Electronic Systems. Additionally, secondary data was obtained from academic literature and research reports related to consumer disputes in e-commerce. The research results show that although legal protection has been regulated normatively, in practice, consumers still face obstacles in the form of low legal literacy, complicated claims procedures, and the limited effectiveness of dispute resolution institutions such as the Consumer Dispute Resolution Agency. Shopee's internal mechanism, the Shopee Guarantee, is relatively helpful, but it does not fully guarantee fairness because the burden of proof remains heavier on the consumer. This highlights the gap between regulations and the implementation of legal protection in the field.
