A Legal Analysis of the Criminal Liability of Perpetrators of Highway Robbery (Judgment No. 1626/Pid.B/2025/Pn Mdn)
Abstract
The increasing number of mugging cases in Indonesia has caused public unrest and demands strict criminal responsibility for the perpetrators. The problems discussed in this research are the forms of criminal liability of perpetrators of mugging crimes under Indonesian criminal law and their application in Decision Number 1626/Pid.B/2025/PN Mdn. This study aims to analyze the legal basis of criminal responsibility and to assess the application of the law by judges in the case. The research method used is normative legal research with a statutory and case approach. The results of the study show that criminal liability against perpetrators of mugging is based on the fulfillment of the elements of a criminal offense, the existence of fault in the form of intent, and the ability of the perpetrators to be held accountable for their actions. In Decision Number 1626/Pid.B/2025/PN Mdn, the panel of judges imposed criminal sanctions on the defendants after they were legally and convincingly proven to have committed the crime. The application of criminal responsibility against the perpetrators of mugging has been in accordance with the applicable legal provisions and aims to provide a deterrent effect as well as a sense of security for the community. Nevertheless, more comprehensive preventive measures are needed through social approaches and consistent law enforcement.
