Strategi Penguatan Pemberantasan Korupsi melalui Pendekatan Non-Conviction Based Asset Forfeiture (NCB-AF) Pada Aparatur dan Masyarakat Desa
Abstract
Corruption is still the main challenge in the implementation of village government because it has an impact on declining the quality of public services, hindering development, and reducing public trust in village officials. Various law enforcement efforts have been carried out, but the mechanism for recovering assets resulting from criminal acts still faces various obstacles, especially if the perpetrator dies, escapes, or cannot be convicted through the conventional judicial process. Therefore, the Non-Conviction Based Asset Forfeiture (NCB-AF) approach is one of the strategic alternatives in strengthening the eradication of corruption by focusing on the confiscation of assets derived from criminal acts without relying on criminal verdicts against the perpetrators. This study aims to analyze strategies to strengthen the eradication of corruption through the application of NCB-AF to village officials and communities, as well as identify factors that support the effectiveness of its implementation. The method used is normative legal research with a legislative, conceptual, and comparative approach, supported by an analysis of international literature, doctrine, and practice regarding asset recovery. The results of the study show that the effectiveness of NCB-AF requires strengthening national regulations, increasing the capacity of law enforcement officials, transparency in village financial management, active community participation in supervision, and synergy between agencies in tracking and recovering assets from corruption. In addition, legal education to village officials and communities is an important instrument to build an anti-corruption culture and increase awareness of the importance of restoring state losses. Thus, the implementation of NCB-AF is expected to be able to strengthen the corruption eradication system that is oriented not only to criminalize perpetrators, but also to optimize the recovery of state assets in order to realize clean, accountable, transparent, and integrity village governance.
